Electronic signatures in South Africa

A practical starting point for understanding ordinary electronic signatures, advanced electronic signatures and why the document and transaction context still matter.

Updated 25 July 2026

Electronic signatures are recognised in many circumstances

South Africa’s Electronic Communications and Transactions Act provides a legal framework for data messages and electronic signatures. The Act does not mean that every document can use the same signing method or that every electronic action automatically produces the same evidential result.

Ordinary and advanced electronic signatures are not the same

An ordinary electronic signature can take different forms depending on the parties’ intention, the method used and the surrounding evidence. An advanced electronic signature is a specific, accredited form used where legislation requires that higher standard or where the parties choose it.

What LulaSign provides

LulaSign supports ordinary electronic-signature workflows and keeps completion and verification evidence. It does not provide an advanced electronic signature.

Suitability depends on the document

Before sending, consider whether legislation requires a handwritten signature, an advanced electronic signature, witnessing, notarisation, registration, original physical delivery or another prescribed formality. Also consider whether the counterparty, regulator, court, funder or internal policy requires a particular method.

Evidence still matters

A useful signing record should help an authorised reviewer understand what was sent, which person completed which required action, when completion occurred, what final document was produced and whether the saved file still matches the recorded result.

Practical checklist

  1. Identify the document and transaction type.
  2. Check for statutory exclusions or prescribed formalities.
  3. Confirm the recipient and signing method are appropriate for the risk.
  4. Keep clear consent, completion and document-integrity evidence.
  5. Apply an appropriate retention policy.
  6. Obtain legal advice where the consequence of getting it wrong is material.
